Terms of Service

India

Effective date: October 19, 2026 (last updated October 19, 2026)

1. Who We Are, and What These Terms Cover

  1. 1.1
These Terms of Service (the “Terms”) govern the manner in which you (“You” or “User”) access and use the TwinCafe website (the “Platform”) and the services made available through it (the “Services”). The Platform and the Services are operated by WisdomLabs AI India Private Limited (the “Company”, We, Us and Our).
  2. 1.2
By creating an account, or by using the Service, you agree to these Terms.
  3. 1.3
These Terms, together with the Privacy Policy (together, the “Policies”) constitute the entire understanding between you and us in relation to the Platform and the Services, and shall be read together.
  4. 1.4
Any matter which is not expressly dealt with in these Terms may be dealt with in the Privacy Policy.
  5. 1.5
We may update any of the Policies from time to time by uploading a revised version on the Platform, and a revised Policy takes effect from the date on which it is uploaded. You should review the Policies each time before you Use the Platform. If you have any objection to a revised Policy, you must raise that objection with Us under clause 11, and you must stop Using the Platform. We shall tell you of a material change through the Platform or by email.

2. Definitions

  1. 2.1
In these Terms, unless the context requires otherwise:
    1. “Applicable Law” means all laws, rules, regulations, notifications, circulars, guidelines, directions and orders in force in India or in the region from which you access the Platform.
    2. “Asker” means a User who asks a question of, or otherwise interacts with, the Digital Twin of another User.
    3. “Background IP” means Intellectual Property owned by or licensed to a party before the date on which these Terms first apply to that party, or developed by that party independently of the Platform, together with all modifications of it.
    4. “Company's Intellectual Property” means all Intellectual Property in and relating to the Platform and the Services, including the underlying algorithms, models, software, source code, architecture, techniques, know how, databases, design, text and graphics, the brand name TwinCafe, and all trade marks, trade names, logos and domain names of the Company, but does not include any content submitted by a User, the Materials or any response which a Twin Creator owns under clause 10.9.
    5. “Digital Twin” means an artificial intelligence persona created by a Twin Creator on the Platform, which is trained on the Materials and the context supplied by that Twin Creator and which generates responses in the first person, and is also referred to as an AI twin or your digital twin.
    6. “Expert” means a Twin Creator who holds or claims any qualification, licence, registration, speciality or professional expertise in any field. Every Expert is necessarily a Twin Creator, and a person cannot be an Expert under these Terms without at the same time being a Twin Creator.
    7. “Twin Creator” means any person who creates a Digital Twin on the Platform, and includes an individual, a company, an association of persons and any other person recognised under Applicable Law, whether or not that person holds any speciality, qualification or expertise in accordance with the warranties under clause 16. A Twin Creator which holds or claims any qualification, licence, registration, speciality or professional expertise is also an Expert, so that every Expert is a Twin Creator, but a Twin Creator need not be an Expert. It is in the capacity of Twin Creator, and where applicable of Expert, that a User supplies the Materials defined at clause 2.1(i), and that definition takes effect accordingly.
    8. “Intellectual Property” means all patents, copyright and related rights, trade marks, service marks, trade names, designs, domain names, database rights, rights in software and source code, trade secrets, know how, confidential information, moral rights, personality rights and all other intellectual property rights, whether registered or unregistered, together with all applications for any of them.
    9. “Materials” means all data and content, including personal data, supplied by a Twin Creator for the training of its Digital Twin and used by that Digital Twin in generating a response.
    10. “Policies” has the meaning given to it in clause 1.3, being these Terms and the Privacy Policy, read together.
    11. “Services” means the services provided through the Platform, including but not limited to the creation of an account, the creation of a Digital Twin, interaction with the Digital Twins of other Users, and access to and Use of the Platform, and a reference in these Terms to the Service is a reference to the Services. In addition, the Services include every service described in any other Policy, including the artificial intelligence inference and embedding services described in the Privacy Policy.
    12. “Use” means access of the Platform and registration on, creation on, interaction on and any other authorised use of the Platform.
    13. “User” means any person who Uses the Platform, and includes a general user, an Expert, an Asker and a Twin Creator.
  2. 2.2
For the avoidance of doubt, an Asker, a Twin Creator and an Expert are each a User, and every obligation of a User under these Terms applies to each of them.
  3. 2.3
A reference to a clause is a reference to a clause of these Terms. Headings are for convenience only. The singular includes the plural. The word “including” is not a word of limitation.

3. Eligibility and Your Account

  1. 3.1
A User below eighteen (18) years of age may use the Service only with the consent of a parent or lawful guardian, and that User's personal data is processed only with such consent, as the Privacy Policy describes. A person under eighteen may not create a Digital Twin, and no voice, likeness or other biometric attribute of a person under eighteen may be supplied as Materials.
  2. 3.2
Acceptance of these Terms on creating an account covers Your Use of the Service as a User. Before You create a Digital Twin You will be asked to accept, separately, the additional terms which apply to a Twin Creator, being the grant at clause 10, the warranties at clause 16 and the declaration at clause 7.3, and a Digital Twin is not published until You have accepted them.

4. What the Service Is

  1. 4.1
For the purposes of the Policies, the Platform lets you create an account, which you may use to interact with the Digital Twins of other Users and to create your own Digital Twin. As a Twin Creator you may upload, edit and remove the Materials from which your Digital Twin generates responses, configure and train your Digital Twin, enable or disable any feature the Platform makes available for it including any voice, avatar, booking, messaging or publication feature, make your Digital Twin public or keep it private, review and correct its responses, and unpublish, pause or delete it. The features available to you may change from time to time.
  2. 4.2
A Digital Twin is not a person and is not a legal entity. Unless the Twin Creator has separately edited a response, added a note or joined the conversation, which the Platform tells you at the time, no human being reads or approves a response before you receive it. Where a message is sent by, or a response is generated by, a Digital Twin, the Twin Creator may review that message or response.
  3. 4.3
A response is general information. It is not professional advice and must not be relied on as professional advice.
  4. 4.4
The Service may be changed, suspended or withdrawn in whole or in part. Where a change is material and adverse to you, we will give you reasonable notice.
  5. 4.5
The Services, as defined in clause 2, are provided and are governed in accordance with these Terms and the other Policies.
  6. 4.6
The Service is provided in English. Where a response is produced from Materials written in another language, or is delivered to You in a language other than that of the Materials, it is a translation and meaning can shift in translation. We do not deliver a response in a regulated field in translation.

5. Pricing

  1. 5.1
Access to the Platform is at present provided free of charge. Where any part of the Services is offered on a paid basis, We set out, before You pay, the applicable prices and taxes, the payment methods, and the terms relating to bookings, cancellations and refunds.

6. User Obligations

  1. 6.1
By Using the Services, every User agrees to be bound by the obligations set out in this clause. If you do not agree to them, you must not Use the Services.
  2. 6.2
You shall not host, display, upload, modify, publish, transmit, store, update or share any information which:
    1. belongs to another person and to which you do not have any right.
    2. is obscene, pornographic, paedophilic, invasive of another person's privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating to or encouraging money laundering or gambling, or an online game that causes user harm, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence.
    3. is harmful to a child.
    4. infringes any patent, trademark, copyright or other proprietary rights.
    5. deceives or misleads the addressee about the origin of the message, or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature.
    6. impersonates another person.
    7. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting to another nation.
    8. contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource.
    9. is an online money game, or an advertisement for or promotion of one, which is prohibited under the Promotion and Regulation of Online Gaming Act, 2025 or any other Applicable Law.
    10. is synthetically generated information which contains child sexual abuse material or non-consensual intimate imagery, which is obscene, pornographic or paedophilic, which creates or alters a false document or false electronic record, which relates to the preparation or procurement of explosives, arms or ammunition, or which falsely depicts the identity, voice, likeness, conduct or statements of a natural person, or a real world event, in a manner likely to deceive.
    11. violates any law for the time being in force.
  3. 6.3
You shall not scrape or extract data from the Service except as we permit in writing, interfere with or probe the Service, bypass any rate limit, verification or security control, or use the Service to compete with us.
  4. 6.4
You shall not present a response as the Twin Creator's current opinion, or as advice given to you personally by the Twin Creator, and you shall not use a response or any generated voice, image or avatar to impersonate any person.
  5. 6.5
You shall give accurate account information and keep it current, shall keep your account credentials secure, shall remain responsible for all activity under your account, and shall tell us promptly if you believe your account has been accessed or used without your permission.
  6. 6.6
You shall not create an account for another person without that person's authority, shall not impersonate any person, and shall not Use the Services under a false identity.
  7. 6.7
You shall not use the Digital Twin of another User to elicit or to generate any response which is in violation of Applicable Law or of the Policies, and you shall not Use the Services in any manner which breaches any obligation which you owe under Applicable Law.
  8. 6.8
The obligations in this clause, along with clauses 7 and 9, are in addition to, and do not limit, any obligation which You may have under Applicable Law or under any other agreement.

7. Twin Creator Obligations

  1. 7.1
In addition to the obligations in clause 6, a Twin Creator, by reason of having created a Digital Twin, agrees to be bound by the following additional obligations:
    1. it shall create its Digital Twin in a manner which ensures that the Digital Twin does not generate any response which is in violation of Applicable Law or of the Policies;
    2. it shall only provide Materials for the purpose of creating and training the Digital Twin which it owns or is licensed to use, and it warrants that the Materials do not infringe the Intellectual Property, personality, privacy or confidentiality rights of any other person;
    3. it shall not permit its Digital Twin to give professional advice in any field in which it is not eligible or qualified to advise;
    4. where it claims any qualification, licence, registration, speciality or expertise in any field, it holds valid and subsisting licences, registrations and other credentials substantiating that claim, and shall produce evidence of them to us on request;
    5. it shall create a Digital Twin of itself only, and shall not create an account or a Digital Twin for or in the name of any other person except as permitted by this sub-clause. Where the name, likeness, voice, persona, character or other attribute which a Digital Twin represents belongs to or is controlled by another person, including a company, an employer, an institution, an estate, or the owner of rights in a fictional, dramatic or performed character, the Twin Creator shall not create or operate that Digital Twin unless it holds a written authority from every person entitled to grant it, and it shall produce that authority to us on request;
    6. it shall keep the Materials accurate and current, and shall remove any Materials which it is no longer entitled to use; and
    7. it is responsible for every response generated by its Digital Twin, and it acknowledges that we are not responsible or liable for any such response or for the Materials on which it is based, save to the extent that clause 14.2 applies.
  2. 7.2
A Twin Creator selects the areas of expertise of its Digital Twin from the list We make available and not as free text, and may select no more than five areas in total. Where an area is marked as regulated, a Digital Twin may carry one regulated area only, and a Twin Creator holding more than one professional licence shall create a separate Digital Twin for each. Where a Digital Twin carries a regulated area alongside an unregulated area, the restrictions which apply to the regulated area apply to the whole of that Digital Twin, and a refusal operates on the question asked, on the Materials retrieved for it and on the response about to be given, rather than on the declared area.
  3. 7.3
Before a Digital Twin is published, a Twin Creator shall declare whether it is the subject of that Digital Twin or is creating it in respect of another person with that person's authority, and shall declare whether it is a general expert, a member of a licensed or regulated profession, or a public figure whose name or likeness carries commercial value. Different obligations under these Terms apply to each, and We may require the declaration to be made again where the Materials or the areas of expertise change.
  4. 7.4
The obligations in this clause are in addition to, and do not limit, any obligation which a Twin Creator may have under Applicable Law or under any other agreement.

8. Artificially Generated Content

  1. 8.1
By default, where the Materials supplied by a Twin Creator are insufficient to generate a response, the Digital Twin generates an automated response. A Twin Creator may switch that feature off, and where it is switched off the Digital Twin generates a response only from the Materials supplied by that Twin Creator.
  2. 8.2
Where the Service produces audio, visual or audio visual information which is artificially or algorithmically created or altered so that it appears real and depicts a person or an event, including a generated voice, image, video or avatar, that information is synthetically generated information. We label that information prominently as synthetically generated, in a manner which is clearly visible or, in the case of audio, clearly audible, and, to the extent technically feasible, we embed in it permanent metadata or a unique identifier which identifies our computer resource as its source.
  3. 8.3
You shall not remove, suppress, alter or obscure any such label, identifier or metadata, and we do not offer any feature which lets you do so.
  4. 8.4
Creating or sharing unlawful artificially generated content may attract penalties and punishment under the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023 and other laws in force, and may lead to removal of the content, suspension or termination of your account, and disclosure of your identity to a complainant who is a victim. Where Applicable Law requires an offence to be reported, including under the Bharatiya Nagarik Suraksha Sanhita, 2023 or the Protection of Children from Sexual Offences Act, 2012, we shall report it to the appropriate authority.
  5. 8.5
A conversation between a User and a Digital Twin does not become part of the Materials of that Digital Twin or of any other Digital Twin, and is not used to train any Digital Twin or the Platform. The Privacy Policy states how a conversation is retained and for how long.
  6. 8.6
You shall not use the Service to create, generate, modify or share synthetically generated information of any kind described in clause 6.2, and we deploy reasonable and appropriate technical measures, including automated tools, to prevent it. Where we become aware of such information, whether on a complaint or otherwise, we may remove or disable access to it and suspend or terminate the account concerned, without notice where clause 13.2 permits it.

9. Expert Obligation

  1. 9.1
In addition to the obligations in clause 6 and clause 7, an Expert agrees to be bound by the following additional obligations.
  2. 9.2
An Expert supplies the Materials from which their Digital Twin generates responses, together with their name, likeness, voice, credentials and public profile content, and grants us the rights we need to host, store, process, reproduce and display all of it in operating, securing and improving the Service, subject to the opt-out described in the Privacy Policy. The Expert is responsible for the accuracy and lawfulness of everything they supply.
  3. 9.3
Every Expert whose name, likeness or voice appears on the Service must have given Us permission to use it. An Expert may withdraw that permission, and we shall then stop using that name, likeness or voice within seven (7) days, and shall deal with the underlying material as the Privacy Policy states. Where the name, likeness or voice is that of another person, or is controlled by another person, the Twin Creator must hold written permission from every person entitled to grant it.
  4. 9.4
Where we describe an Expert's background or credentials on the Service, that description is based on information supplied by the Expert, which we will produce to a regulator on request.
  5. 9.5
An Expert warrants that it owns, or is licensed to use, every part of the Materials it supplies, that it is entitled to grant the rights granted under these Terms in respect of them, and that no part of the Materials is supplied in breach of any third party right or of any professional, employment, confidentiality or contractual restriction binding on it. An Expert shall remove any part of the Materials which it ceases to be entitled to use.
  6. 9.6
Where an Expert is a member of a licensed or regulated profession, it shall comply with every rule of professional conduct binding on it, including any rule on advertising, solicitation, touting, the sharing of fees, client confidentiality, privilege, conflicts of interest and record keeping, and it shall not supply as Materials anything covered by a duty of confidence or of privilege owed to any other person. We may suspend or remove a Digital Twin, or any part of its Materials or its profile, where a regulator or professional body objects to it or where in our reasonable opinion it does not comply with such a rule.
  7. 9.7
Where an Expert is a member of a licensed or regulated profession, We undertake to that Expert that We shall not advertise or solicit work on its behalf, shall not present it as associated with or employed by Us, shall not rank, rate, score or compare it against any other Expert, shall not take any share of any fee it earns, shall not route or refer any User to it through any lead flow We design, and shall suspend its Digital Twin on notice of a disciplinary reference or of an objection from its professional body. These undertakings are given because the Expert answers to its own professional body for them.
  8. 9.8
We undertake to every Twin Creator that, where the automated response feature described in clause 8.1 is switched off, its Digital Twin will be configured to answer only from the Materials supplied for it and not to assert an opinion which those Materials do not support, that it may inspect a record of what its Digital Twin has said in its name, and that where it suspends or removes its Digital Twin We shall confirm to it in writing what was removed and when.

10. Intellectual Property Rights

  1. 10.1
The Company's Intellectual Property vests solely in the Company or in its licensors. No right, title or interest in the Company's Intellectual Property passes to you or to any other person under these Terms, and in no event shall it pass to any other party.
  2. 10.2
We grant you a limited, non exclusive, non transferable and revocable licence to access and Use the Platform in accordance with the Policies, and your rights in relation to the Platform are limited to that licence.
  3. 10.3
You retain ownership of the Materials and of all other information, data and content which you submit to the Platform. You grant us a non exclusive, royalty free and worldwide licence to host, store, reproduce, process, adapt and display it, only so far as is needed to operate, secure and improve the Platform and the Services and to comply with Applicable Law. In respect of the Materials, that licence covers creating, training, operating, securing and improving Your own Digital Twin, and training and improving the Platform unless You opt out as the Privacy Policy describes.
  4. 10.4
All intellectual property in the Service, including its software, design, text, graphics, trade marks and the Digital Twin technology, and everything in it other than your content, the Materials and any response which a Twin Creator owns under clause 10.9, belongs to us or to our licensors. You may not copy, adapt, reproduce, distribute, publicly display or create derivative works from any of it except as these Terms expressly permit.
  5. 10.5
Nothing in this clause protects you against any claim by a third party that the Materials, or any other thing you submit to the Platform, infringes the rights of that third party, and nothing in this clause gives you any right in respect of anything which is not yours.
  6. 10.6
Separately from the licence at clause 10.3, a Twin Creator grants Us a licence over each of the following, in respect of itself and of any person whom its Digital Twin represents with that person's authority, named separately because each is a different thing: its name, and any alias, nickname, honorific or other name by which it is known; its likeness, photograph and image; its voice, and any synthesised, cloned or otherwise generated version of its voice; any avatar, facial template, voiceprint or other model derived from its image or its voice; its signature; its performances; and its recorded manner of expression. That licence is non exclusive, royalty free and worldwide, and is granted only for creating, training, operating, securing and improving that Twin Creator's own Digital Twin, for displaying that Digital Twin on the Platform, and for training and improving the Platform unless the Twin Creator opts out as the Privacy Policy describes.
  7. 10.7
Unless they end earlier under this clause, each licence at clauses 10.3 and 10.6 continues, for anything in which copyright subsists, for the full term of that copyright and, for anything else, for so long as the relevant Digital Twin remains on the Platform or, where no Digital Twin is concerned, for so long as is needed for the purposes in clause 10.3. They are not limited to five years. Where a Twin Creator withdraws its consent to the operation of its Digital Twin or removes it, the licences end in accordance with the Privacy Policy, save for what We are required by Applicable Law to retain, and where the Twin Creator is an Expert, clause 9.3 also applies.
  8. 10.8
The licences at clauses 10.3 and 10.6 extend to Materials and to attributes supplied after the date on which they are granted, and a Twin Creator is not required to grant a fresh licence each time it adds to the Materials.
  9. 10.9
As between a Twin Creator, a User and Us, the Twin Creator owns any response generated by its Digital Twin, and We and the User who asked the question each receive a non exclusive, royalty free licence to use that response, We for the purposes of operating the Service and that User for its own purposes. This clause allocates ownership between the parties to these Terms. It does not decide, and cannot decide, who is the author of a computer generated work under the Copyright Act, 1957, and where there is no such author there may be no copyright in a response at all. Nothing in this clause affects the moral rights of an author or of a performer, which subsist independently of copyright and are not affected by any assignment or licence.

11. Complaints and Grievance Redressal

  1. 11.1
You may complain about anything on the Service by writing to Us.
  2. 11.2
We shall acknowledge your complaint within twenty-four (24) hours. We shall resolve it within seven (7) days of receipt. You need not hold an account with us to make such a complaint, and another person may make it on your behalf. Where a complaint asks for the removal of information of a kind described in clause 6.2, we shall act on it within thirty-six (36) hours, and where it concerns content which on the face of it exposes the private area of the complainant, shows the complainant in full or partial nudity or in a sexual act, or impersonates the complainant in electronic form, including by artificially morphed images, we shall remove or disable access to it within two (2) hours. We act on an order of a court, or on a reasoned intimation from the appropriate Government or its authorised agency, within three (3) hours of receiving it.
  3. 11.3
We take all reasonable measures to make the Platform accessible to Users, including Users with disabilities. If any part of the Platform is not accessible to you, please tell Us and we shall offer an alternative.
  4. 11.4
If you are not satisfied with Our decision, or your complaint is not resolved within the period stated in clause 11.2, you may appeal to the Grievance Appellate Committee constituted by the Central Government, through its online portal at gac.gov.in, within thirty (30) days. A complaint about how your personal data has been handled may be taken to the Data Protection Board of India as permitted by Applicable Law.

12. Your Rights

  1. 12.1
Your rights in relation to the Platform, the Services and your information are governed by these Terms and by the Privacy Policy, and extend only to what has been expressly granted to you under the Policies. You have no right in relation to the Platform, the Services, the Company's Intellectual Property or any Digital Twin other than as expressly granted. Nothing in these Terms limits any right or remedy which you have under Applicable Law, including under the Consumer Protection Act, 2019.
  2. 12.2
We respect the rights accorded to citizens under the Constitution of India, including under articles 14, 19 and 21.
  3. 12.3
Nothing in these Terms is an admission about how the Service is characterised in law. We reserve every defence and exemption available to us, including under section 79 of the Information Technology Act, 2000, and nothing in these Terms waives any of them.
  4. 12.4
An Expert sees the responses of its own Digital Twin and aggregate information about its use. It does not see an identifiable transcript of a conversation between another User and another Digital Twin. A conversation with one User is not used to answer the question of another User.

13. Suspension and Termination

  1. 13.1
You may stop using the Service or delete your account at any time.
  2. 13.2
We may suspend or terminate your access where you breach these Terms, where we are required to do so by law or by an order of a court or authority, or where your use creates a serious risk to the Service or to another person. Except where the law or the risk requires immediate action, we shall give you notice and an opportunity to explain.
  3. 13.3
Where we remove or disable access to any information, or where your registration is cancelled or withdrawn, we preserve that information and the associated records for not less than one hundred and eighty (180) days for the purposes of investigation, or for such longer period as the Privacy Policy provides or a court or a lawfully authorised Government agency requires. We provide information under our control, and assistance, to a lawfully authorised Government agency within seventy two (72) hours of receiving its written order.

14. Disclaimers and Liability

  1. 14.1
The Service is provided on an as is and as available basis. We do not warrant that it will be uninterrupted or error free, or that any response will be accurate, complete or current.
  2. 14.2
To the maximum extent permitted by Applicable Law, we, our affiliates and our and their respective directors, officers, employees and agents shall not be liable to you for any loss, damage, claim, cost or expense of any kind, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, arising out of or in connection with the Service, the Platform or these Terms. We shall be liable to You only to the extent that such liability cannot be excluded under Applicable Law, and any such liability shall, to the extent that Applicable Law permits it to be limited, be subject to clause 14.3.
  3. 14.3
Subject to clause 14.2, our total aggregate liability to you arising out of or in connection with the Service and these Terms shall not exceed the greater of the total amount you paid us in the twelve (12) months before the event giving rise to the claim, and Rs. 10,000 (Rupees Ten Thousand only).
  4. 14.4
Subject to clause 14.2, we are not liable for loss of profit, loss of business or indirect or consequential loss.
  5. 14.5
An Expert is responsible for the material they supply, for their conduct in any session with you and for any opinion or advice they give you directly. Subject to clause 14.2, we are not liable for the acts, omissions or advice of an Expert, and nothing in these Terms makes us a party to any professional relationship between you and an Expert.
  6. 14.6
A Twin Creator is responsible and liable for every response generated by its Digital Twin and for the Materials on which that Digital Twin is trained.
  7. 14.7
Each User is responsible and liable for its account and for all activity carried out under it in the course of its Use of the Services.
  8. 14.8
Where a User breaches any obligation under clause 6, clause 7, clause 9 or clause 10, that User is liable for that breach.
  9. 14.9
Subject to clause 14.2, we have no liability in respect of any response generated by a Digital Twin, or in respect of any claim brought by a third party in relation to a response, the Materials or the Use of the Services by any User.
  10. 14.10
Nothing in these Terms limits or excludes any right, remedy or claim which a third party may have against a User under Applicable Law, and nothing in these Terms limits any right or remedy which we may have against you under Applicable Law.

15. Indemnity

  1. 15.1
You shall indemnify us against any loss, claim or cost arising from your breach of clause 6, clause 7, clause 9, clause 10 or clause 16, from your infringement of another person's intellectual property, personality or privacy rights, from any claim in relation to the Materials or to a response generated by your Digital Twin, or from your fraud or wilful misconduct.
  2. 15.2
Where We claim under clause 15.1, We shall give You prompt written notice of the claim, shall allow You to participate in its defence at Your own cost, and shall not settle it in a manner which admits Your liability without Your consent, which You shall not unreasonably withhold. You shall give Us all reasonable cooperation. Nothing in this clause requires Us to delay any step We are obliged to take under Applicable Law or to comply with an order of a court or authority.

16. Representations and Warranties

  1. 16.1
